Investments Secrecy
Investments secrecy refers to the discretion and confidentiality which administrators, their bodies and employees are required to maintain regarding any information that they learn about the financial and personal affairs of their clients. So that this secrecy is not subverted or misused, the law has taken several measures to punish any abuse.
Legal Proceedings
Investments secrecy is not a protection for criminals nor is it absolute. For instance, a criminal court judge can issue an injunction ordering investment secrecy to be lifted, including when ruling on applications lodged by a foreign prosecution authority acting via the international mutual legal assistance program.
In legal proceedings for the recovery of debts or in cases of corruption, investments secrecy will also be lifted if the debt in question has been subject to a writ of execution issued by any judge.
